Warning about DNA Analyses: Most DNA analysis is unreliable. Also, the recent revelations (see Wall Street and other news outlets' articles in 2024 on DNA testing) of misconduct or fraud in testing DNA or drug samples. There is bias and even misconduct by testers and those issuing 'expert certificates' – who are often current or former police force employees, as well as misinterpretation by juries, judges and lawyers alike. Labs are not all the same and procedures are not all uniform or not followed. Also, matching a bullet pattern to a gun is made-up. You cannot match a pattern.

A quote from the article entitled Police Training Needs Reform: Prejudice is learned and can be unlearned. (Part 1): ... Of course, our service and protection in the community was many times anything but peaceful. But peace was always our goal. The 1957 Law Enforcement Officers Code of Ethics, which we all pledged to follow, was given to each of us. In part, it said:

"As a law enforcement officer, my fundamental duty is to serve the community; to safeguard lives and property; to protect the innocent against deception, the weak against oppression or intimidation and the peaceful against violence or disorder; and to respect the constitutional rights of all to liberty,
equality, and justice.I will keep my private life unsullied as an example to all and will behave in a manner that does not bring discredit to me or to my agency…I will constantly strive to achieve these objectives and ideals, dedicating myself before God to my chosen profession… law enforcement."

(This powerful and personal pledge of service has, sadly, been replaced, in many agencies, by the Law Enforcement Code of Conduct, which has removed the references to God, and other parts of the original.) That was the general state of law enforcement for the nation. But more than that, our own General Orders Manual, featured the following orders from the command staff to all personnel:

"The application and enforcement of the law must be accomplished in the spirit set forth by the framers of the Constitution. The rights of each citizen are equal with those of the state, which might accuse him."~Mesa PD Gen. Order 01.103~ ...

Sadly, these general orders aren't a part of the MPD manual today. Contemporary training of recruit officers is much different, and militarism has crept in, along with the idea that cops are better than the citizens, and must supervise them...

President Thomas Jefferson state in his work entitled "The Values of the Constitution" called the Sheriff's Office "the most important of all executive offices of the country. The Sheriff's power and authority are from the people who elect him. The citzens should control the office of Sheriff."

(It should be noted that President Thomas Jefferson included bold anti-slavery language in the original Declaration of Independence, which was removed. He did get passed by Congress in 1807 a bill outlawing the importation of slaves--it took effect in 1808.) And Wisconsin Territory was part of the Northwest Territory, where slavery had been banned by an act of Congress in 1787 at the urging of Thomas Jefferson.

The Sheriff can be traced back not only to the Magna Carta (1215), but to the Book of Daniel 3:2 when King Nebuchadnezzar II (634--562 BC) was reigning. The Sheriff was brought over to North America around 1634 and President Thomas Jefferson (1801-1809) called the office of the Sheriff "the most important of all executive offices of the country." [See Sheriff David Gee of the Florida Hillsborough County Sheriff's Office established in 1845 (HCSO has over 4,000 employees that conists of 2,022 Deputy Sheriffs and Corrections and 1,375 civilians) for further details. CIA Killing 100,000> Year Selling Heroin In U.S.A. Our Troops Protecting Opium-Heroin --The System is Rebelling over Drug Laws thanks to Law Enforcement Against Prohibition (LEAP)--mandatory sentences are assinine and the Drug War is a Joke.

LEAP does not promote drug use; however, prescription medications kill an estimated 300 percent more people than illegal drugs and the American Medical Association (AMA) admits that adverse reactions of FDA-approved medications kill nearly 300 people every single day--causing over 106,000 deaths in the U.S. each year. [It is wrong Biblically to take drugs unless it is for medical reasons, but look at the anti-depressant drugs we are giving to our children that are much more dangerous--all the school shooters were on some kind of anti-depressant drug (see ADHD/No to Ritalin Tab and Homeland Security Tab on how to prevent school shootings. Disarming law-abiding citizens is not the answer and help for school officials from Protecting Our Students and Teachers--POST--the POST program for schools is based on the Federal Flight Deck Officer Program (FFDO) because only 2% of U.S. flights--5,000 commercial planes in the air at one time--have armed marshals aboard; see The Truth about Airline Security--from the Pilots Themselves. Under the program commercial pilots, flight engineers, and navigators may carry firearms and they are sworn and deputized Federal Law Enforcement Officers and authorized under TSA). The criminalization of drugs has caused much harm to society (our Constitution trashed) and taxpayers (incarceration & legal costs)--I rather see the money going to educate the students against taking drugs including dangerous anti-depressant pharmaceutical drugs. See The DEA Struck Deal with Mexico's Most Notorious Drug Cartel (the Sinola drug cartel) and allowed them to smuggle billions of dollars in drugs to the U.S. (01/14/14) & Feds Caught Shipping Cocaine into U.S. (TV Commentary & also reported in El Paso Times).

Note: In the early 2000s, synthetic illicit drugs have been increasing in America at an alarming rate. What were these drugs? It consisted of synthetic cannabinoids (marijuana), synthetic cathionones (amphetamines called "bath salts" that included off-brand codeines, hydrocodones (Norco and Vicodin) and oxycodones (Oxycontin and Percocent). In 2017, those drugs are still lucrative, but there is something more deadly--it is the synthetic heroin call FENTANYL. China has become the world's leading manufacturer and exporter of illicit synthetic opiods in the U.S.-- China ships hundreds of pounds at a time of the powder to Mexixo where the drug is altered to make it 100x more potent then normal heroin and then shipped the United States; the Sinaloa Cartel calls their Fentanyl-heroin mix "El Diablito" or "The Little Devil." Unlike THC in marijuana that allows recepotor sites in the body and brain to stay partially clear and the body will eventuall dispose THC via urinary or sweat excretion, SYN-THC is a full agonist and covers the mu reciptor sites in the brain and is much harder for the body to break it down.

"Bath Salts", sometimes called plant food, are a synthetic derivative of the natural amphetamine and psychoactive East African plant Khat. Like SYN-THC drugs, bath salts are manufactured in the People's Republic of China and exported legally in the U.S. See the SCP Journal (Volume 41:1 -- 41:2, 2017) article entitled Designer Drugs: Destroying a Generation by D.G. Spillman.

To counter overdoses, five pharmaceutical manufacturers market a Narcan auto-injectable or spray. It is Naloxone sold under the brand name Narcan. The initial 2014 wholesale price was $690 for a package of 2 auto-injectors. Now Evzio is charging $4,500. Not acceptable.

Retired DEA Agent Robert Stutman, who was recruited in college by the CIA, has this to say about America's war on drugs in the World of Firepower, DEC/JAN 2013 issue, page 27: "Unfortunately, the biggest source of supply is not foreign countries, it is prescription drugs ... Prescription drugs kill more people than heroin, crack and methamphetamine combined. It's not the drug cartels in Mexico, it's the physicians overwriting prescriptions that kids get a hold of, use and die from. The problem is no longer the traditional dope dealer." Mr. Stutman retired in 1990 and founded the The Stutman Group, a management consulting firm that designs and implements comprehensive and practical substance abuse preventive programs for corporations and school systems across the country.

"Due to the ill-advised drug war and the endless federal expansion of the criminal code, we have over 6 million people under correctional suspension, more than the Soviets ever had, and more than any other nation today, including China. I don't understand the complacency of the Congress and the willingness to continue their obession with passing more federal laws. Mandatory sentencing laws associated with drug laws have compounded our prison problems." Should Marijuana be legalized?

A Brief History of the Drug War (video) --It was the UN in 1961 that came up with the so-called "War of Drugs." In 1971, President Nixon implemented the "War on Drugs" based on the UN and other former Presidents such as Bush, Clinton, Obama continued the policy. What did this do? It packed our prisons, oppressed the poor and middle class in America, especially the African-American community. It increased police misconduct, and the cost of law enforcement, etc.

Note: HHS (Health and Human Services) spending is $5 billion to combat drug abuse and the opioid epidemic. There is nothing new in American history with epidemics. The use of morphine during the Civil War led to a major drug problem afterward, while the 19th-century over-the-counter opiated laudanum that was prescribed for menstrual pains was abused by housewives. Even President Lincoln's wife was a laudanum addict. The early 20th centur saw the federal government began to regulate food and drug products by implementing the Food and Drug Act of 1906 and the Harrison Narcotics Tax Act of 1914. This has led to the unending war on drugs that has caused havoc on society untold billions of dollars to taxpayers, which is unconstitutional. Also, the Bible gives certain restrictions under the New Covenant about the role of Christians in government on what can be legislated--yes, drug use is a sin for non-medical reasons or being a drunk; however, it is something that Christians, liberals, conservatives, etc. should not be for laws that put people in jail over it. We know fornication is sin, but we do not arrest people for fornication or adultry--God said he will judge the sexually immoral and not to worry about what the non-believer does in their bed. Of course, if they are abusing children, then they should be arrested. The church is not a sacral society and not under the Mosaic Covenant (only ancient Israel was a theocracy). Of course, murder such as abortion should be illegal. (See Politics & Voting Tab.)

Legalization of marijuana and whether it is Biblical are two different subjects.

Under the authority of God via the Bible, there are limits on the authority of Church, State, Family and Business spheres (click NJIAT's Politics Tab and go to the sub-topic titled "What about the State's Authority over a Citizen"?) The Scriptures recognize four (4) sovereign spheres of authority: 1. Church (1Thess. 5:12-13; Heb. 13:17, 24 etc.); 2. State (Rom. 13:1-7; 1 Pet. 2:13-17 etc.); 3. Family (Eph. 5:22-29; Eph. 6:1-4, etc.); and 4. Business (Eph. 6:5-9; 1 Pet. 2:18-19, etc.).

For example, we know the Bible states that fornication, drunkenness, adultery and homosexuality is sin. However, the New Testament tells us He (the Lord) will judge fornicators (the non-Christian). So,do we enact laws (the State) to arrest all fornicators, adulterers, homosexuals, drunks, etc.? Of course, not! Is there a difference between a person who fornicates and a person who fornicates with a prostitute? Show me in the Bible. Why is one legal and the other illegal in most states?

Now there are Federal and State laws that Christians and non-Christians are authorized to influence or change such as stopping child abuse (pedophilia, teaching sin to our children via the public school system (Common Core based on Agenda 21, transgender and homosexual lifestyles, etc.), infanticide, suicide, incest, rape, abortion, forced vaccinations--click to the learn the risks, forced anti-depressant drugs (all the mass shooters were on this drug), anti-1st Amendment (especially, freedom of religion and the Internet) and anti-2nd Amendment laws, etc. Example: Samson, from the tribe of Dan and  judge/ruler of Israel for 20 years, had miraculous strength and was a Nazirite. Samson destroyed the Philistine's temple used as a religious sacrifice to their false god Dagon--the judgment was over sacrifice to the false god, not prostitution (see Book of Judges). (Governments are prohibited and not giving authority by God to interfere in those spheres (church, family--that includes the public schools--mentioned above.)

The Bible condemned the Israelites and the Gentiles for these practices mentioned above, but the Gentitles were not condemned over the Sabbath (the Sabbath only applied only to the Israelites under the Mosaic Covenant that was defective and obsolete -- the other 3 Covenants are still valid: Noahic, Abrahamic, and New Covenant). Unfortunately, you have "21st century Christian Pharisees" and misguided "Theonomists" (theonomy is not supported under the New Covenant -- the Church is "not" a Sacral Society like ancient nations, that is, a Covenantal nation with soldiers, jails, etc. See Dr. Morey's book entitled How the Old & New Testaments Relate to Each Other).

Medical benefits: Cannabinoids found to reduce seizures in children with epilepsy. Medical use is not sin! And supporting legalization and decrimininalization of recreational marijuana does not imply that a person supports people using it for non-medical reasons!

Note: While opioids certainly are a menace, the U.S. Constitution gives no authority to the federal government to wage a war on drugs. Solution to Police Abuse of Civil Rights is not Federalizing Police:

Do not Federalize the Police like "Nazi Germany" [this is what the Bush Sr., Clinton, Bush Jr. and Obama Administrations (Black, Democrat Sheriff: Obama Fueling Racial Division for Federal Takeover of Police-05/11/15) want to impliment] the U.S. citizens will then end up with total tyranny and oppression--see Special Report: Federalized Police Force Rising (05/01/15):The police state intensifies as feds absorb law enoforcement nationwide). “The militarization of American policing has occurred as a direct result of federal programs that use equipment transfers and funding to encourage aggressive enforcement of the War on Drugs by state and local police agencies,” notes the ACLU.

Merge any unelected county police force into the Sheriff's Office. Only use the Sheriff's Office that is an elected Constitutional county law enforcement office that should be more sensitive to "Civil Rights" and change the "draconian drug laws" (in 2012, 1.55 million people were arrested on non-violent drug charges and of those 749,825 people were arrested for marijuana drug violations. Since 1980, 25.4 million Americans have been arrested on drug charges and of that number a third are black--the former Clinton administration and other administrations implimented these draconian drug laws that in effect served as a precursor to the police state we now see going on and the U.S. has spent $51 billion in 2014 on the so-called war on drugs) and "police training methodology"--we do not need the UN to police America and disarm the police or citizens (see Public law 87-297 signed in 1961).

Also, Professor Walter Williams of George Mason University (The New American Magazine, May 4, 2015, pages 23-24) breaks down illegitimacy rates: Black families were very strong prior to 1964 compared to now (23% illegitimacy rate in 1960, 1925 85% of black households were two-parent households and as of 2014 70% are female-headed). Of course, the white families (illegitimacy rate for Whites is 29% and 53% illegitimacy for Spanish as of 2014) are falling apart too and were much stronger years ago. This has to do with a rejection of God and the government's anti-family policies, especially against the black community. For example, the white racists in police departments and the FBI in the 1940s and 1950s allowed drugs to be shipped into the poor black communities by organized crime. (Free trade agreements such as NAFTA, the WTO, the North American Union (NAU) , the proposed Trans-Pacific Partnership (TPP) etc. are even more harmful economically to the black community and also hurts all Americans.) What has happened? Read the following facts and articles below:

1. Despite making up just 13% of the population, blacks commit around half of homicides in the United States. DOJ statistics show that between 1980 and 2008, blacks committed 52% of homicides, compared to 45% of homicides committed by whites; 2. More up to date FBI statistics tell a similar story. In 2013, black criminals carried out 38% of murders, compared to 31.1% for whites, again despite the fact that there are five times more white people in the U.S.; 3. Despite the fact that black people commit an equal or greater number of violent crimes than whites, whites are almost TWICE as likely to be killed by police officers. 4. Black Crime Facts That the white Liberal Media Daren't Talk About --Police brutality targeting blacks will not subside until this becomes part of the national conversation ; 5. Flashback: U.S. Army Training to Fight Black Americans--"Doomsday Disneyland" facility used as practice ground for civil unrest; 6. After The Fed Crushed The Middle Class, It Is Targeting The American Family--One key observation: race matters far less than it did in decades past and class matters far more; 7. Police Consolidation: The End of Local Law Enforcement--merging local Twp. Police Depts. has been a budgetary disaster and will set the stage for the creation of local police departments becoming an outpost of the federal law-enforcement agency such as the DHS & the use of Public-Private Partnerships (PPPs) is another bad idea (see above article)---this is not the case with the Sheriff's Office (an elected Constitutional Office). This is why any mergers planned should only be done thru the Sheriff's Office. [The Sheriff's salary is set by NJ Statute (a minimum base is set)--Freeholders in individual counties in NJ have the option to give the Sheriff a higher salary than the minimum base. Thus it will always be a lower cost operation and citizens will keep their direct control and local sovereignty (many high ranking NJ State Police support merging thru the Sheriff's Office)--any county police force such as Bergen County and Union County (duplication of services) should be merged into the county Sheriff's Office.

Note: The Merger is official as of Feb. 25, 2015. Bergen freedholders make it official: County police folded into the Bergen County Sheriff's Office. It is disgraceful that Republican Freeholder Maura DeNicola opposed the move. Freeholder DeNicola should read the Constitution and have a concern for citizens' Civil Rights--yes, the Sheriff is directly accountable to the people. It is also a cost factor and a duplication of services. Shameful behavior from a Republican.

History background: Senator Gerald Cardinale submits bill to merge Bergen County Police with Sheriff's Department]. The Bergen County Freeholders who voted yes for the merger should be complimented, but County Executive Kathleen Donovan (who is either misinformed or intimidated by the county police) should be ashamed of herself for any opposition in mergering the county police force into the Bergen County Sheriff's Office--an existing county law enforcement office that has one of the top forensic labs in the State.

Warren County Sheriff's Office in NJIt should also be noted that the Warren County Freeholders put the Corrections facility under the direct control of the Warren County Sheriff's Office in 2011--hopefully, the same thing will be done with the Department of Public Safety (DPS), that is, it should be under the Sheriff's Office. Thumbs up for the Warren County Freeholders and Sheriff Gallant, who retired as a Captain in the NJ State Police (see About Warren County Sheriff's Office -- Sheriff Gallant's two undersheriff's are also retired Captains in the NJ State Police). Unfortunately, former Sheriff Gallant was not very pro-active in offering services.

Congratulations to the current Sherrif (James J. McDonald Sr., 2019) of Warren County, NJ, who is pro-active. He trying to offer law enforcement services such as patrol services to other muncipalities and save the taxpayers thousands of dollars.

Counties should not be setting up a county police force when they are already have an existing county police force called the Sheriff's Office.  This is a duplication of services and is contrary to shared services. The Sheriff's Office is not only more cost efficient, but it already exists and will always be a lower cost operation--the Sheriff's salary is set at a minimum by NJ Statute, but Freeholders can raise the salary. Most of the Sheriffs' Offices in NJ are under Civil Service that keeps the costs down and curbs political favoritism.

New Jersey or PA Townships have two options for Police Departments:

1. You can keep your township police department and just reduce it thru attrition. If a Twp. needs supplemental coverage, they can contract out with the Sheriff’s Office;

2. They can merge into the Sheriff's Office on a contractual basis (you do not want to penalize other townships who do not want to use the Sheriff's Office by having everyone pay for it, especially if they are using the State Police)—you would still have satellite offices in the respective townships.

3B. Why the Sheriff's Office (an existing county law enforcement office) should be used to Supplement or for the Consolidation of Township Police Departments

Sheriff Badges

Los Angeles County Police that is under the Office of Public Safety (a duplication of services) merged into the Los Angeles County Sheriff's Department (LASD)--the Los Angels County Board of Supervisors (BOS) voted on 12/15/09 by a 4-1 vote to consolidate the Los Angels County Police into the Los Angeles County Sheriff's Office (LASD)--an already existing county law enforcement office. (The Los Angles County Sheriff's Office services an area greater than 12,308 square kilometers with everything from gangster-infested holes south of downtown to celebrity-infested Malibu in the West; it has 8,500 Deputies and traces its roots back to the wild west of 1850s California.) This should be an example, especially for counties that have separate county police departments (merge them into the Sheriff's Office), and for other states in this country to use - this will save taxpayers millions of dollars (read articles below). It is recommended that this cost saving strategy be implemented in New Jersey and other States.

Townships could be supplemented by the Sheriff's Office

Yes, township police departments could be either supplemented or be merged into the Sheriff's Office (on a contractual basis--yes, the township has the option to keep all their police officers; it is a contract between the county and the individual township and the township can increase or decrease the amount of unit hours it wants). If the municipality wants to keep their police dept., but reduce costs, the municipality could reduce the size of their municipal police department and supplement its patrol functions and investigations with the Sheriff's Office as needed thereby saving the taxpayers thousands if not millions of dollars.

Merging into the Sheriff's Office

Merging into the Sheriff's Office is a better option because of the time factor--the township would start saving money immediately because the overheard costs would be less--no chief, and the other administrative functions streamlined. I have have spoken to many retired or active high ranking New Jersey State Troopers (About Warren County Sheriff's Office--the Sheriff and the two Undersheriffs are retired Captains in the NJ State Police), Federal Agents and former or current Sheriffs who agree that the local police departments should be merged into the county Sheriff's Office, an existing county police force. It should also be noted that former Hunterdon County Judge Thomas J. Beetel of Flemington, NJ (who served in World War II in Naval Intelligence--China) proposed having the Sheriff’s Office patrol the county and former Mayor Andrew Leon of Delaware Township, NJ (who served in World War II as a Navy Seabee—Guam and Bikini Atoll) was against starting a township police department.

Do not Consolidate Township Police Departments

Do not consolidate township police departments—the taxpayers will end up with a huge, high cost consolidated township police department that is not accountable to the people and would probably end up with the county taken it over. (The Sheriff's Office is a Constitutional Office--the NJ Constitution decrees that the Sheriff is the highest elected public law enforcement officer in the county--that has jurisdiction throughout the county and the Sheriff is elected by the citizens of the county and thus accountable to the people and the most cost effective.)

Lieutenant in the New Jersey State Police Prepared Detailed Report and Proposal for Hunterdon County to be Patrolled by the Sheriff's Office

A detailed report and proposal (for county patrolling) was submitted to the Hunterdon County Freeholders in the late 1990's by former Sheriff Bill Doyle (a retired Lieutenant in the New Jersey State Police, who also served 12 years as Sheriff (1996-2007), and your most qualified and best Sheriff that Hunterdon County every had). Also, a Hunterdon County Sheriff's Office Shared Services Proposal for a Patrol Division was submitted to the Freeholders in 2008 that offered a comprehensive cost analysis of patrol (active and passive) and investigative services for 10 municipalities in Hunterdon County--see all reports under the heading "Official Government Reports on Successful Mergers of Twp. Police Depts. into the Sheriffs' Offices"; also see the summary entitled Contracting Out Services of the Hunterdon County Sheriff's Office (2010)--PDF. Mr. Capobianco, Hunterdon County Shared Services Coordinator, stated on January 25, 2010 at an East Amwell meeting that the Sheriff's Office is the most cost effective method of policing the county. Mr. Capobianco is correct--if implemented properly, it would save thousands of dollars in property taxes per household every year.

Most Sheriffs' Offices in the Country perform all Law Enforcement Functions

Most Sheriffs' Offices across this country including Sheriffs' Offices in New Jersey perform the following: countywide patrol functions such as traffic control and accident investigations, process applications for a license to carry firearms, courthouse security, civil law enforcement, civil processes such as court orders, writs, executions, summons, tax liens, subpoenas, Sheriff sales, operate their county jail, transport prisoners, etc. All Sheriff's Officers are certified law enforcement personnel that go through the same police academies and training that township police officers have to go through--they both receive certification from the PTC (Police Training Commission) that authorizes them to patrol, to perform search and seizure, etc. A Sheriff's Officer has jurisdiction in the whole county--this is not the case with a township police officer.

Many Sheriffs' Offices offer Specialized Services to the County

Many Sheriffs' Offices also offer specialized services to the county in addition to uniform patrol, when needed, at no extra cost to the taxpayers, which consists of the following: Homeland Security, Emergency Services (SWAT), Haz-Mat Team, Bomb Squad, Air Patrol, Marine Patrol, Criminal Investigation Unit, Narcotics Investigation, Hostage Negotiation, Warrant Squad, Internet Crime Unit, and other law enforcement activities such as cigarette-tax enforcement (NYC Sheriff's Office), etc. See the Passaic County Sheriff's Office for an example of a New Jersey Sheriff's Office that offers most of the specialized units mentioned above in addition to their community-based programs such as Senior Citizen "Are You OK Program" and the Student "Reality-Check" Program. Passaic County Sheriff's Office patrols the portion of Rt 80 in Passaic County. A township police department does not have the personnel or money to have the specialties or expertise that would be offered through bigger departments such as the Sheriff's Office or State Police.

4. Why Councilman Harmen Vos wants to either Supplement Clinton Twp. Police Dept. Using Sheriff's Officers or Merge it & Unethical Behavior by a few Township Committeemen, Freeholders and Police Chiefs in Hunterdon County

Councilman Harmen VosCouncilman Harmen Vos of Clinton Twp.(2011 to Dec. 31, 2013), who served as a Sergeant Commando in the Royal Dutch Army, under NATO, Special Forces--Green Berets, has made it clear at the event that after a careful study he wants to either supplement the Clinton Twp. Police by using Sheriff's Officers to offset the high cost or merge the police dept. into the Sheriff's Office. (This is not getting rid of the police dept. per se--it is on a contractual basis between the Twp., county and Sheriff; the Twp. can keep their police Dept. and just use a few Sheriff's Officers to offset the high costs or they could merge the police dept. The Police Officers would become Sheriff's Officers and would patrol Clinton Twp. with occasional rotation with other Sheriff's Officers.) This would entail no layoffs of the current Clinton Twp. Police Officers--no, the Officers would not have to take a Civil Service test to get hired because it would be a merger of an existing police dept. into the Sheriff's Office that is between the individual Twp. and Sheriff's Office on a contractual basis. They would be integrated into Civil Service. Over half of law enforcement in New Jersey fall under Civil Service regulations (Department of Personnel; Title 11) according to New Jersey State Association of Chiefs of Police. Civil Service curtails politics in promotions and is less expensive. If townships merged into the Sheriff's Office, there would be precincts/satellite offices throughout the county--there would be no difference in response time. The Sheriff's Office would actually have a faster response time. (Just recently (in April, 2012) you had a Police Officer from Clinton Twp. Police Department arrested for illegal possesson of a drug. The Clinton Twp. Police Department was also taken over by the Prosecutor's Office a few years back because of misconduct.)

Police Chiefs Held Special Meeting after the Summary for "Contracting Out Services" report using the Hunterdon County Sheriff's Office was released on 09/07/10

It should be noted when the summary for Contracting out Services of the Hunterdon County Sheriff's Office was released on 09/07/10, the police chiefs in Hunterdon County had a special meeting; they were upset over the summary, which was not reported by any of the local newspapers. The local newspapers also did not report at the East Amwell meeting on January 25, 2010 that the Freeholders withheld The Hunterdon County Sheriff's Shared Services Proposal (2008) that should have been included in the Blue Shield Consulting Report and the statement made by Mr. Capobianco, Hunterdon County Shared Services Coordinator, that the Sheriff's Office is the most cost effective. What is happening in Hunterdon County is that some Freeholders (maybe only one Freeholder at this present time) and a few Township Committee Members are trying to push the idea of consolidating township police departments instead of reducing them, merging them into the Sheriff's Office or contracting out the services with the Sheriff's Office. Beware of any disinformation about the Sheriff's Office by township police departments, some township committeemen and a few Freeholders—many might be misinformed, do not understand the issue, or are deceptively working behind the scenes with the twp. police departments instead of representing the people. This is very dangerous and costly. The Freeholders and the townships will end up creating a high cost county police force with out of control costs such as the Bergen County Police and Nassau County Police. The county Sheriff's salary is set by New Jersey Statute, but have the Freeholders have the option to give a Sheriff a higher salary and no Undersheriff or Sheriff's Officers can make more than the Sheriff—this puts a cap on all salaries. This is not the case with township police departments or a county police force.

The Sheriff's Office is an already existing County Police Force

Sheriff and Community Preparedness Team (CPT)

The Sheriff's Office, an already existing county police force, is the most efficient way to go. Hunterdon County could also save money just by putting the correctional facility (the whole DPS) back under the Sheriff's Office instead of laying off custodians from the court house and contracting out their services—Hunterdon has multi-million dollar lawsuits against it, which could have been prevented. Contact Sheriff Fred Brown , a straight shooter, about using the Sheriff's Office to reduce police costs to the local municipalities in Hunterdon County--there are false rumors being circulated by some Raritan Twp. Committeemen that Fred Brown recommended the current police chief in Raritan Twp. and is not in favor of supplemental police coverage from the Sheriff's Office if the municipalities request it. This is an outright lie and not Sheriff's Brown's position. Unfortunately, Freeholder Rob Walton was quoted in the Hunterdon County Democrat (08/04/11) by Terry Wright in an article titled Officials explore shared services that Sheriff Brown would not be interested in offering shared services for municipal police departments--this is a lie and Sheriff Brown has made it clear he will offer services if requested by the municipalities. Freeholder Director Matt Holt, an honest guy, had to correct and rebuke Freeholder Rob Walton publicly for misinformation over the Sheriff's Office at a Wine Tasting Event sponsored by the Clinton Twp. Republican Club at the Hampton Inn on 09/23/11--yes, a DPS merger with the Sheriff Office might be considered and the Freeholders would work with muncipalities who are interested in using the Sheriff's Office.

Note: The current Freeholder Board in Hunterdon County as of 2020 are incompetent when it comes to offering services of the Sheriff's Office--look at what happened to their county jail; contracted out with Somerset County and now is with Warren County. It is a financial nightmare. Then Hunterdon Freeholders wanted to contract "Raritan Twp. Police Dept." to transport prisoners--stupidity on the highest level. They are even using the DPS in addition to the Sheriff's Office to transport prisoners.

Hold your Township Committeemen/Women and Freeholders Accountable

Hold the township committeemen and Freeholders, especially newly elected Freeholder Rob Walton (who has been running around the county trying to promote a high cost county police department, which is a duplication of services that already exists through the Sheriff's Office) accountable and tell them you had enough of this nonsense. There are also reliable allegations being made in Hunterdon that a few Hunterdon County Freeholders told Sheriff Fred Brown that the Sheriff's Office is really only an administrative office. If this is true, it is a stupid statement--the Sheriff is the top law enforcement officer in the county. The Freeholders also cut his budget--he should have another Undersheriff. However, the good news is that there are a few Hunterdon County Freeholders who are open to using the Sheriff's Office on a contractual basis.

Note: There is strong evidence that the Raritan Twp. Police Chief might have been the one who called the special meeting--according to allegations made by reliable sources--with other police chiefs in Hunterdon County to discuss how to counter the summary submitted to municipalites titled, Contracting out Services of the Hunterdon County Sheriff's Office (2010)--see PDF summary under the topic "Official Government Reports." If the allegations are true about the meeting, it is very unprofessional conduct for police chiefs. This website has always supported local law enforcement and the Sheriff's Office. Supplemental coverage is probably the way to go for 85% of townships in most counties--yes, the twp. would still have their police department! This site is against Twp. police mergers or creating another county police force.

5. Seal of Somerset County, NJSomerset County Freeholders, Somerset Prosecutor and One Hunterdon County Freeholder Misleading the Public about Twp. Police Mergers (that will create another county police force--a duplication of services) that already exists thru the Sheriff's Office

The proposed merger of 21 Twp. police departments in Somerset County into one department made up of precincts (21) is a big mistake and stupid. (Contact Sheriff Frank Provenzano in Somerset and ask him what is his problem; this should be done through his Office, which is an existing county law enforcement office). The proposal for the 21 Twp. Police Departments in Somerset County to merge and then create a county police force is stupid. Somerset County is duplicating services (the Sheriff's Office is an existing county police force where each Twp. can legally merge their police department on a contractual basis into the Sheriff's Office and the other townships who do not merge with the Sheriff's Office do not have to pay for the other townships who do so because it is a contract between the Sheriff, Freeholders and the individual township)--the so-called savings for the 21 Twp. Police merger is a joke because it requires massive layoffs and a county police force is always more costly in the long run unlike the existing lower cost operation of the Sheriff's Office. The Sheriff's starting salary is set by NJ Statute and it is at the discretion of the Freeholders if they want to give the Sheriff a higher salary depending on his/her responsiblities--most Chiefs of Police in New Jersey townships make more than the Sheriff! Most of the Sheriffs' Offices in New Jersey are under civil service and as a result holds the costs down in addition to many other factors. The Somerset Prosecutor should be ashamed of himself because it is about him having control of the force not about protecting the citizens and cost savings to the taxpayers. The Courier News even admitted that the savings over 10 years keeps getting adjusted down from previous estimates. This is also contrary to what other States are doing--merging Twp. 2 1/2 year Study by the Somerset County Freeholders?

There was no reason for the Somerset County Freeholders to commission a 2 1/2 year study about merging or consolidating township police departments. The Freeholders could have had a two week free study from the Sheriff's Office or National Sheriff's Association. Having the Sheriff's Office patrol or supplement townships in Somerset County is the most efficient and cost effective--it is also easier to negotiate police contracts for townships who want to merge into the Sheriff's Office. There is no need for former Somerset County Freeholder Jack Ciattarelli and now Assemblyman for the 16th District and an intelligent man, and Hunterdon County Freeholder Rob Walton to promote legislation in New Jersey to authorize or make it easier for municipal police departments to merge. Legislation for township mergers to help consolidate schools or other services is acceptable, which Freeholder Ciattarelli is also supporting.

[The real plan by some of the Hunterdon and Somerset County Freeholders such as Freeholder Rob Walton and Assemblyman Jack Ciattarelli is to create a high cost county police force that is under their control, not the people--the plan has already been exposed by the Star-Ledger July 10, 2011 edition, section on Somerset & Hunterdon, page 22 entitled Somerset County plan to share police forces hits bump. The study was prepared by consultant Thomas Banker that would create three police precincts where the individual municipalities would initially be charged based on how many of their officers joined in the effort, but then it would become the county's burden--it is not only a duplication of services that already exists through the Sheriff's Office, but this proposal was already made by many Sheriff's' Departments in this state including the Hunterdon County Sheriff's Office. Yes, this was suppose to be done through the Sheriff's Office! Merging township police departments will create a county police force down the road. A county police force will be much more costly than than the Sheriff's Office; the Sheriff's salary is set by NJ Statute. I would assume that Hunterdon County Freeholders Will Mennen and George Melick would be against creating a county police force that would end up with out of control costs like the Nassau County Police or the Bergen County Police that were going to get 9.79% raise each year for four years according to an article by Northjersey.com dated 03/12/11 entitled Bergon County Police give up raises to stave off layoffs--the Bergen County Sheriff Michael Sardino should propose having the Bergen County Police Dept. merged into the Sheriff's Office and also implement a volunteer program (a reserve unit) like Essex County Sheriff's Office and the other Sheriffs' Offices across this nation. Unfortunately, if a Sheriff was a former chief, they do not want to upset their fellow chiefs by actually doing what is right and represent the PBA instead of the people. ( Freeholders Mennen and Melick should be commended for taking this position of not starting a separate county police force)--they should talk some sense into Freeholder Rob Walton and the Somerset Freeholders. If the municipalities want the county to help out, then let them contract out the services with the Sheriff's Office; the municipalities would reimburse the county for the cost of the Sheriff's Officers used on a contractual basis only.]

The municipal police departments are able to legally merge or supplement their departments through the Sheriff's Office. The real issue was that the Freeholders do not want to give up control that included the Somerset County Prosecutor. The Sheriff and the County Prosecutor are Constitutional Officers. The difference being is that the Sheriff is elected by the people, thus more accountable to the people whereas the county prosecutor (a State Constitutional Officer) is appointed by the Governor and controlled by the Attorney General--look at the former Somerset County Prosecutor (Nicholas Bissell) who was indicted on 30 counts of criminal activity by a federal grand jury in 1996; since he was appointed, he could only be removed by the Governor and thus the citizens had a bad prosecutor in Somerset from 1982 through 1996. In Pennsylvania the Prosecutor or District Attorney is elected. They will end up with a high cost county police force and a duplication of services (the Sheriff's Office is an already existing county law enforcement police force). This is stupidity on the highest level.

Somerset County Sheriff's Office--the Somerset County Freeholders and Prosecutor tried to circumvent the Sheriff's Office (the chief law enforcement officer in the county) by a proposed 21 Township Police Departments' merger in Somerset County by starting a separate county police force that is not accountable to the people and is more costly and should not be done--this is creating another county police force with out of control costs and is a duplication of services (the Sheriff's Office is an existing county police force and Bergen County just merged their county police force into the Bergen County Sheriff's Office in 2015). Any police mergers should take place through the Somerset County Sheriff's Office. The police chiefs put pressure on the former Sheriff when he proposed having the township police departments merged into the Sheriff's Office years ago and thus saving the taxpayers millions--the twp. police departments could also use the Sheriff's Office as a supplement, thus reducing costs and they can keep their police department. This can be done on a contractual basis with each individual township. Call your current Freeholders and Sheriff and tell him that the citizens want this done through the Sheriff's Office regardless if the police chiefs and prosecutor do not like it (too bad). Note: The Somerset County Prosecutors Office should not have a Swat Team when the Somerset County Sheriff's Office has a Swat Team/Special Response Team --- see Somerset County Sheriff's Office/Special Response Team. The Somerset Prosecutor's Swat team should immediately be transferred to the Somerset Sheriff's Office. Michael H. Robertson, Somerset Prosecutor (since 2016), should concentrate on prosecuting criminals and transfer specialized units (Rescue, Swat, Dive Team, etc.;many of the units the Somerset Sheriff's Office already has--duplication of services) into the Somerset Sheriff's Office; these are units that belong under the sole control of the Sheriff's Office. Essex County Sheriff's Department

Essex County Sheriff's Office in New Jersey--this is a Sheriff's Office that all the counties in the State of New Jersey should model themselves after. The have the following divisions: Patrol Division (which includes securing the Essex County parks (6,000 acres)--no park rangers),Narcotics Division, Homeland Security (the person in charge is a former Assistant Special Agent for the FBI NJ Divisional Office in Newark), Emergency Services, Volunteer Deputy program, etc. Somerset County and Hunterdon County need to get their head out of the sand and use their Sheriff's Office for police mergers and the DPS in Hunterdon County should be under the Sheriff's Office.

Passaic County Sheriff's Office

Passaic County Sheriff's Office in New Jersey--this is another excellent example of a Sheriff's Office in NJ. Under the Bureau of Law Enforcement: Uniformed Patrol, this division also deploys the following specialized units whenever they are needed throughout the county, at no extra cost to taxpayers: Bomb Squad, Crisis Response Team, Emergency Services Unit, Haz-Mat Team, Special Weapons, Scuba Team, Criminal Investigations Division, Narcotics Investigations, Water Resource Protection Unit, Internet Crime Unit, Fugitive Warrant Squad, Crime Scene Unit, Marine Patrol, Public Safety Telecommunications, E-911 Call Center, and Hostage Negotiation.

New Bergen County Executive Signs Deal Merging Bergen County Police Dept. Into the Bergen County Sheriff's Department (01/01/15) & Bergen County begins Merger of its Police Force into the Sheriff's Office on NJ.com --We would like to congratulate Bergen County Executive James Tedesco for merging the Bergen County Police Dept. into the Sheriff's Office, which is an existing county police Dept. (this was a duplication of services). Bergen County Executive James Tedesco did the right thing. We also would like to congratulate Sheriff Michael Saudino for agreeing with this merger and his hard work to make it happen.

Note: The Merger is official as of Feb. 25, 2015. Bergen freedholders make it official: County police folded into the Bergen County Sheriff's Office. It is disgraceful that Republican Freeholder Maura DeNicola opposed the move. Freeholder DeNicola should read the Constitution and have a concern for citizens' Civil Rights--yes, the Sheriff is directly accountable to the people. It is also a cost factor, duplication of services and Civil Rights issue. Shameful behavior from a Republican. The DPS should also be under the Sheriff's Office and communications (the Prosecutor is not an elected office in NJ (it is elected in NY and PA, etc.) and should not dictate to the people of Bergen County--an unelected Constitutional Office is a joke!).

Montgomery County Sheriff's Office

Montgomery County Sheriff's Department in PA--The Office of the Sheriff in the Commonwealth of Pennsylvania is authorized and established by the PA Constitution of 1784; it is the chief law enforcement officer of the county per PA Constitution. The office does a variety of duties and has specialized services such as a Bomb Disposal Unit, (C.E.R.T.) County Emergency Response Team, etc. PA Township Police Departments should be merged into the Sheriff's Office because it is the most cost effective and they have jurisdiction in the whole county, which makes it easier for mergers. This can be done on a contractual basis with each township.

Allegency County in PAAllegheny County Sheriff's Office in Pennsylvania located in Pittsburgh, PA. They have a volunteer Uniform Reserve program or Deputy Reserve Program and are authorized under Title 18 with full arresting power in addition to their full-time Sheriff's Officers. Yes, the Allegheny County Police should be merged into the Allegheny County Sheriff's Office (the Sheriff Dupities are duly trained from Act 2 Sheriff Training and through 120 MPOETC (Municipal Police Officers' Education and Training Commission). This is a "Duplication of Services" issue and a "Civil Rights" issue and a "cost factor" issue. The Sheriff's Office is less expenisve--Allegheny Count Sheriff's Officer can only retire at age 55, a county police officer can retire at 50.

Note: PA Sheriff Dupities are duly trained either under Act 2 Sheriff Training or 120 MPOETC (Municipal Police Officers' Education and Training Commission) such as Sheriff's Office in Pittsburgh. A quote from the Sheriff's Association of New Jersery: A look at a six (6) year old Pennsylvania Supreme Court case, the court held that the "constitutionally designated sheriff in the Commonwealth of Pennsylvania is a law enforcement officer who is vested with full powers and duties to stop motor vehicles, issue citations for motor vehicle violations under statutory code, and make arrests with or without warrants" (Commonwealth of Pennsylvania vs. Leet, 585 A.2d 1033). Sheriffs and their deputies are basically police officers. Judge Carillo, who presided over this case, even went as far as writing how "instinctively,..., we are reminded of Sherwood Forest, where the Sheriff of Nottingham was the chief law enforcement officer who possessed far-reaching powers" and "King Henry of England states to the Sheriff of Nottingham,...But look well to it, Master Sheriff, for I will have my laws obeyed by all men within my kingdom, and if thou art not able to enforce them, thou art no sheriff for me."

It is Disgracelful for Union County and Camden County in New Jersey to have a separate county police force when the Sheriff's Office is an existing county police force (duplication of services).

Union County and Camden County should immediately merge their county police force into the Sheriff's Office (an elected Constitutional Office) like Bergen County did in 2015 and Essex County in 1997 (see above). Firearms Purchaser ID Card

New Jersey residents have to apply for a "Firearms Purchaser ID Card" in order to purchase rifles, shotguns or handguns. You must go to the Police Chief of the municipality where your reside or the Superintendent of the State Police. The police department should have the forms to fill out and you will have to make an appointment for fingerprinting. The forms can also be printed off the New Jersey State Police website. (Click "Forms to Download" for the Firearms Purchaser Identification Card/Application to Purchase a Handgun. One also needs to fill out the Consent for Mental Health Records Search with firearm application and 3 personal references and bring to your local township police department--see the New Jersey State Police Site on Forms to Download.) Pennsylvania residents can buy a gun without a special card in PA (they have to show valid identification)--they are still run through an extensive background check via the National Instant Criminal Background Check System (NICS) by the licensed dealer and are either approved, denied or put on pending status. The "NICS" was started in 1988 and is operated by the F.B.I.--the operations in NJ are run by the State police. (A licensed firearms dealer must contact the "NICS" via telephone or facsimile and then will receive determination of whether the prospective purchaser would violate Federal or State law.)   Applications for a PA resident “License To Carry Firearms” (LTCF) must be submitted to their county sheriff’s office, with exception of Philadelphia where they are handled by the Gun Permits & Tracking Unit of the Philadelphia Police Department. All permits issued by one county must be honored by all counties including Philadelphia.  If the resident or non-resident is approved, they are issued a permit that is valid for 5 years--this should be the method in New Jersey.  The process of obtaining a PA LTCF is very thorough in making sure that permits are not granted to people that may be irresponsible or pose a danger to others. New Jersey makes it harder and more expensive for law-abiding citizens to purchase a firearm; the background check is no different from Pennsylvania's background check when going into a licensed dealer to purchase a firearm (the person is run through "NICS").

How long should it take for an application to be approved or denied?

The applicant should be approved or denied "within 30 days form the date of receipt of the application for residents of this State and 45 days for non-resident applicants." This law is under N.J.S. 2C:58-3(f).

Address change for New Jersey Firearms Purchaser Identification Card (FPIC)--it is called "duplicate firearms purchaser identification card", which has been combined into one form in 2015 (check appropriate block(s))

Under New Jersey Administrative Code 13:54-1.11, a holder of a NJ Firearms Purchaser Identification Card must apply for a change of address with 30 days of such change of address. How to does a person change his/her address or name change? One applies to the Chief of Police in the municipality where the applicant currently resides (new address) or to the Superintendent of the State Police if they police your area. What form must be filled out? Ask for an application for a "duplicate firearms purchaser identification card" and a consent for a mental health records search--this is all that is required under the New Jersey Administrative Code 13:54-1.11 (b). It is not the same application for a Firearms Purchaser Identification Card (you already have the card). To get the two correct forms from the official New Jersey State Police website, click the following: Application for Duplicate Firearms Purchaser Identification Card (no longer used--The Application for Duplicate Firearms Purchaser Identification Card has been combined into one form that has "check appropriate block(s)") and Consent for Mental Health Records Search. These are the only two forms you need. The applicant pays a small fee. Some police departments such as Clinton Twp. Police Dept. were erroneously making people with a FPIC, who recently moved to Clinton Twp., apply for a new FPIC This is stupid and a violation of the law. The Clinton Twp. Police Dept. is also making township citizens, who are applying for a FPIC, to sign a waiver if it takes more than 30 days--this is very unethical. Make sure the police are giving you the correct forms. It should look like the official NJ State Police forms above. If you are having problems with your local police, contact the Association of NJ Rifle & Pistol Clubs of New Jersey.

Firearms Seized in New Jersey and not Returned to You because of Domestic Violence Allegations will loose their Gun Rights

This law has been on the books since January 14, 2004. NJS 2C:58-3. C. (8) and NJS 2C:39-7. b. (3) states that if the State is holding your guns or your guns were not returned to you (e.g. sold to a dealer, transferred to a third party, destroyed by the State, etc.), you lose your gun rights in NJ. Anyone with guns "seized and not returned" who purchases or possesses a firearm faces five years in the NJ State Prison. (Do not simply agree to have your seized guns sold to a dealer, transferred to a third party, or forfeited ot the State--you have too many scumbbag prosecutors and judges in NJ who don't tell the unsuspecting gun owners that their gun rights will be lost by making such a deal with the State.) The law is not only unconstitutional, but it is a disgrace that the NJ State Police has failed to ask about it on gun permit application forms and Certificates of Eligiblility.

What about Possession and Transporting Hollow Point Bullets in New Jersey?

Yes, but only by the way of exemptions under N.J.S. 2C:39-3.g.2 and N.J.S. 2C:39-6f. (i.e, dwelling, land owned or possessed; while hunting, fishing or target shooting; place of purchase). The exemptions are:

1. N.J.S. 2C:39-3. f., possession of hollow nose ammunition is prohibited unless a person is engaged in activities pursuant to N.J.S. 2C:39-6f. that includes target shooting and hunting.

2. N.J.S. 2C:39-3 subsection g.2, a person can keep this ammunition at his dwelling, premises or other land owned or possessed by him and may carry such from the place of purchase to the above locations. Law enforcement and military are also exempt.

Also, New Jersey alllows magazine capacity (10) rounds (N.J.S. 2C:39-1y) in 2019. It was (15) rounds before 2019--this limited magazine capacity is unfortunate.

There have been false arrests by Officers because they are unaware of the exemptions. For more detailed information on the above, see the New Jersey State Police Site on Hollow Point Bullets or The New Jersey Office of the Attorney General for further information on weapons/firearms.

Advice: Under N.J.S. 2C:58-15, it is unlawful to store a firearm where the individual knows or should know that a minor (defined as under the age of 16) could gain access to it.  It is advisable to purchase a gun safe--gun safes can be obtained at a reasonable price and prevents thieves, drug addicts, gangs, etc. from stealing your weapons and protects you legally. The exemptions of N.J.S. 2C:58-6.1 still allow minors to access firearms. (There is no sales tax on gun safes in New Jersey.)

Interstate Transportation of Firearms (The Federal Firearms Owner's Protection Act of 1986 (FOPA)
Title 18, Part 1, Chapter 44, Sections 926A of the United States Code
:

"Not withstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, that in the case of a vehicle without a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked container other than a glove compartment or console."

The FOPA protects those who are legally transporting firearms by automobile or plane for lawful purposes. FOPA protects firearms owners traveling through gun-unfriendly jurisdictions; it does not protect those traveling to those places. See Cornells University's law pages and David T. [The judge (James Morley) in Brian Aitken's trial (a law enforcement officer arrested him in 2009 after searching his car--Aitken was moving from his parent's home in Mount Laurel, NJ to Hoboken and had legally purchased firearms from Colorado locked and unloaded in his car trunk because he was going to transport them) refused to instruct the jury about the federal statute. Gov. Chris Christie granted clemency to Aitken. The judge and prosecutor should be removed from their positions and charged criminally for this act.]

Inheriting Firearms

A person can inherit firearms under N.J.S 2C:58-3j. Firearms pass upon death of the owner to the heir or legatee whether by testamentary bequest or the laws of intestacy. There is no requirement to have a permit or identification card as long as the person is not disqualified to possess firearms. A so-called "assault firearm" can be inherited if it is in another state such as Pennsylvania. It is very important to have a Will stating that you are leaving your firearms to your chosen heirs, which does not have to list the make and model or serial number--this allows for the legal transfer of firearms without the necessity of permits. Do not "register your firearms"--this is not required in NJ! You have some idiot Twp. Police Departments in New Jersey recommending that citizens "voluntarily register their firearms" if they inherit any firearms. Just like Nazi Germany! An attorney should prepare the Will (laws change & might be different in your State) and every gun owner no matter what State they live in should have this in their Will. Former NJ Attorney General Paula T. Dow Misrepresents the Facts About Right-to-Carry

The NJ Attorney General responsed to the Right-to-Carry lawsuit brought by the Second Amendment Foundation (SAF) and ANJRPC by arguing that the right to bear arms does not apply outside the home (see Association of New Jersey Rifle & Pistol Clubs for more details). She has also made statements that issuing concealed carry licenses is a danger to society. Attorney General Dow stated in her brief: "...When handguns are permitted to be carried beyond one's home, the dangers and risks necessarily increase and are borne by the public." (She also asserted the primacy of state's rights to "ensure the safety of all of its citizens" against Mr. Muller's "alleged right" to self-defense outside the home.) Where did she get her facts? Risks increase? Maybe for the criminal. Reasonable regulations? According to the FBI, on average, Right-to-Carry states have a 24% lower violent crime rate than states without the self-protection law! Does the NJ Attorney General realize that over 37 states have "shall-issue" laws for permit holders (uniform standards, not subjective as NJ) and over 40 states have Right-to-Carry? The "shall-issue" states have an impeccable safety record (for example, Florida has issued 1.8 million permits since 1987 to 2010 and only 167 permit holders had their licenses revoked or .01 percent of permit holders--most were for accidently carrying in a gun-free zone. Carrying a firearm is a "right" not a "privilege," according to the Bill of Rights--see article entitled The Right to Carry Concealed Weapons for Self-Defense. The States have the authority under the 10th Amendment to nullify any unconstitutional laws from the Supreme Court or Congress. For example, the North, shortly before the Civil War, passed laws nullifying the Fugitive Slave Law in spite of a Supreme Court decision. There are 8 States that have passed the Firearms Freedom Act. It is about time that Governor Chris Christie (a nice guy) take a Constitutional and Biblical worldview on self-defense and ownership of firearms. The current view against firearms is a secular humunist worldview, which is sin and against God. (Denying concealed carry licenses to law abiding citizens in cities that have a high minority population and the crime rate is high is racism on its highest level--see A New Film entitled No Guns for Negroes that exposes the Racist Origins of gun control implemented on the Black Community (it features a prominent pro 2nd Amendment Black American activist, who is a member in a respected Black Civil Rights organization and former mayor of a Chicago suburb—he exposes the White Liberals and their “PC Pimps” in the Black Community)—PDF or download the DVD film for free entitled No Guns for Negroes.) Note: In February, 2009, the New Jersey Supreme Court ruled in State v. Pena-Flores, 198 N.J. 6 (2009) that a police officer with probable cause for a stop may not search a vehicle without consent unless exigent circumstances exist.

Law enforcement officers and certain military personnel are allowed under this new law the Right to Carry (RTC) in any state or district in the U.S.  If a police chief or superintendent is not permitting you (the law enforcement officer) to carry in another state, the police chief or superintendent could be violating federal law—call the NRA’s division of Civil Rights Defense Fund.   [Note: The law was envisioned to be a bar to arrest and/or prosecution if you are a qualified off-duty or retired law enforcement officer and carrying in another state—however, there have been problems with states such as New York ( a gun hostile state) not obeying federal law. Two (2) recent cases where law enforcement officers were arrested in New York: 1. A Pennsylvania Constable named Rodriguez in 2006 and; 2. A Coast Guard cop named Booth in 2008. In both cases the judge ruled that Rodriguez and Booth were not guilty of a gun crime because under the Law Enforcement Officer’s Safety Act of 2004—a federal law--preempted state law.   • Law Enforcment Officers Safety Act of 2004 (LEOSA)— H.R. 218 and S. 1132 are not the acutal laws per se; USC 18 & 926B (specific active-duty law enforcement) and 926c (pertains to "retired" law enforcement) are the laws created and were improved through the two acts. Yes, if a officer left after vesting in retirement (service after 10 years), but before the required age to collect a retirement are now covered. In other words, you just need 10 years of aggregate service.
  • A retired cop from another state does not have to go back to his/her state to do their yearly qualifications under the LEOSA Improvement Act (a.k.a. Public Law 110-272)--they can qualify in the state they are living in. Unfortunately, the IACP has been against this law because the have their head 'you know where'. Amtrak police, the Federal Reserve and executive branch of the Federal Government are now under the umbrella of LEOSA. Police officers should look at their ID to make sure your agency is in compliance with these laws. See summary on the “Law Enforcement Alliance of America’s” website. There have been allegations that New Jersey has been violating this federal law against NJ retired law enforcement officers living in another State.   • NJ State Police: Concealed Carry for Retired Cops Application --you can go thru the New Jersey State Police or your local Township Police Dept. (the State Police approves or disapproves the application, not the Twp. Chief of Police). If the superintendent approves a retired officer’s application or reapplication to carry a handgun pursuant to the provisions of this subsection, the superintendent shall notify in writing the chief law enforcement officer of the municipality wherein that retired officer resides. In the event the retired officer resides in a municipality which has no chief law enforcement officer or law enforcement agency, the superintendent shall maintain a record of the approval. Current and retired law enforcement officers are eligible to obtain a permit to carry a handgun without specific justifiable need, pursuant to N.J.S.A. 2C:39-6.l. These permits are administered by the Superintendent of State Police and not subject to judicial review unless the officer was denied and is appealing a denial.

It is highly recommended that retired law enforcement personnel have the National Concealed Carry HR218 Badge to avoid friendly fire and identify yourself. Notice to law enforcement: On October 9, 2006, President George Bush signed into law the “Disaster Recovery Personal Protection Act.”  This bill, introduced by Louisiana Senator David Vitter, and then-Representative (now Governor), Bobby Jindal (R), protects gun owners’ rights during times of emergency. It passed Congress with massive bi-partisan support (322-99 in the House, and 84-16) in the Senate.  It is illegal under this new federal law for any law enforcement officer to confiscate law-abiding citizens’ firearms during a civil emergency. [The federal law was the result of Hurricane Katrina (08/29/05) where some cops, feds, and National Guard units used the complete breakdown of civil order as an excuse to harass, intimidate, and physically abuse private citizens—they also confiscated thousands of guns, leaving law-abiding residents of the city with no means of defense against bands of thugs and looters roaming the streets at night (see Soldier of Fortune, September 2008 edition, for article titled The Great Gun Grab, pages 12-18).

There are millions of law-abiding citizens, law enforcement officers, Fire Fighters, and military personnel who are either hunters, competition shooters or both and believe in the original intent of the 2nd Amendment. There are 40 "Right-To-Carry" States (RTC)--37 have "shall issue" laws, which establishes uniform standards established by the State legislature. The States that have "Right-To-Carry" (RTC) have an impeccable record with their licensees. According to John Lott and David Mustard--authors of the book entitled Crime, Deterrence, and Right To Carry Concealed Handguns--States that passed concealed handgun laws their county murders fell by 8.5 percent, and rapes and aggravated assaults fell by 5 and 7 percent. (My cousin in Texas could have been either raped or murdered if she did not pull out her .38 revolver when she was being approached in a parking lot at night--fortunately, the man fled when he realized she was armed!) Gun-free zones are open invitation for terrorists or thieves--you should never prevent law-abiding citizens, who have a "concealed handgun" permit, from carrying in a school, university, park or church. (The Virginia massacre might have been prevented if the university did not prohibit students, who have a "concealed handgun permit", to have their weapons on campus--there was a gun incident 5 years ago [Jan. 16, 2002] at Virginia Tech where one student was killed and three others wounded by a 43-year-old student from Nigeria--however, the shooter was subdued by two law-abiding armed students, Tracy Bridges and Mikael Gross; they both had to run to their vehicles to retrieve their firearms.) If you are a law-abiding citizen and interested in learning how to use a firearm safely for self-defense, hunting, or competition, please click    "Right-to-Carry" or the link located on side bar. (There are universities that have shooting ranges on their campuses and high schools that have rifle clubs--this has been a great blessing for the students, country, military and police. Many of our military snipers are from the South because they grew up hunting and target shooting.)

Also, if you are a peace officer, hunter, sportsmen, etc. and do not belong to a pro 2nd Amendment organization such as the NRA, GOA, JPFO, etc. you do not deserve to have a gun. The 2nd Amendment is not about sporting and hunting rights--you can ask my Polish Jewish friend, who is a "holocaust" survival, about the purpose of the 2nd Amendment. When Nazi Germany enacted "Regulations against Jews' possession of weapons," it made every Jew register their firearms and then the SS Reichsfuhrer would do a search-and-seizure for any firearms in Jewish homes--it was known as the Reichskristallnacht (Night of the Broken Glass) that occured in 1938. The policies were promulgated in every country conquered by Hitler--Polish Jews were ordered by the Wehrmach in 1941 to turn in their guns or get the death penalty. (The Nazi Weapon Law of 1938 made every citizen register their firearms--it was signed by Adolph Hitler.) Stalin also murdered between 10 to 20 million peasants.

This is why the so-called "assault weapons," which are not fully automatic and erroneously labeled this name by anti-gun organizations, should be allowed in every State and is a 2nd Amendment right--they are semi-automatic firearms (with military cosmetics) and account for less than one-half of 1 percent of violent crime! Many law-enforcement personnel know that the positions taken by their superiors against firearms in general or the so-called "assault weapons" are the result of political pressure and are outright lies. A case in point is a friend of mine--who retired as a "Major" in the New Jersey State Police--told me/alleged that the Colonel/Superintendent of the New Jersey State Police had to take an anti-gun position because the Governor at that time (1980's) told him to take that position. Also, many high ranking New Jersey State Police Officers are afraid to speak up about the gun issue (support the 2nd Amendment that includes the Right-to-Carry and the so-called assualt weapons) even though they know what is being told to the public is a lie.

11. Law Enforcement's Obligation to Fullfill their Oath that they took to the Constitution and Police Organizations that Agree and Support Officers

Crowley, Winona Police Department, Winona, Missouri, regarding the Obligation of Law Enforcement to teach the Constitution and 2nd Amendment when they hold firearms courses that was published in the American Cop Magazine pages 10-11, September 2012 edition.

I'am the Chief of Police for a small town in south-central Missouri. I'am also an academy instructor, firearms instructor, as well as an instructor for a small firearms training company located in the same area. I, along with my fellow cadre, teach constitutionality each time we hold a firearms course.

I am lucky in that I live and work in Missouri, where the Missouri Constitution, Article 1, BILL OF RIGHTS, Section 23 to be precise, states: "That the right of every citizen to keep and bear arms in defense of his home, person or property, or when lawfully summoned in aid of the civil power, shall not be questioned; but this shall not justify the wearing of concealed weapons." We teach this in our courses, as well as the Bill of Rights, 2nd Amendment to the US Constitution. We also attempt to stay current on US Supreme Court rulings, and proposed legislation here in our state. We pass this information along to our students and citizens as often as possible.

In most law enforcement academies we are taught to strictly adhere to the 4th, 5th and 14th Amendments, but rarely hear anything about the 2nd Amendment. I believe it is as much our duty to advise people of their constitutional rights, as it is to protect them from wrongdoers. Upholding the Constitution is part of our oath. I also believe we in law enforcement are in a unique position, as citizens often rely upon us to be authorities on the law. I feel it is our duty as officers to uphold every citizens right to keep and bear arms. There are instances when the law oversteps its bounds in that some municipalities enact ordinances which restrict the citizens' rights to carry. The word "bear" is used as a verb, and is defined by Merriam-Webster as--carry. There is no gray area here. The Constitution is clear on this matter, and the US Supreme Court has affirmed this as a clearly established individual right.

I too know law enforcement officers who spout anti-gun rhetoric. I think those lawmen who use the "It's my duty to protect them, so they don't need to be armed" mindset, are behind the power curve, not living in reality. We lawmen are so few in number, citizens would be foolish to assume we can protect them from every violent encounter. I'am reminded of a joke: " I carry a gun because cops are too heavy."

I took the long way around to answering the question Roy posed. I, along with many of my close friends in law enforcement will not ever confiscate guns from law-abiding citizens. I will not follow nor issue an order which is unconstitutional, and until the constitutions are amended--and I hope that day never comes--I will continue to protect the gun rights of the citizens I serve.
